​Welcome to WorkSwipe, a video-based recruitment platform connecting job seekers and employers through innovative media technology. These Terms of Service ("Terms") govern your access to and use of our website, mobile application, services, and content (collectively, the "Services") provided by WorkSwipe Inc. (“WorkSwipe,” “we,” “our,” or “us”), a corporation registered in Ontario, Canada.

By accessing or using our Services, you agree to be legally bound by these Terms. If you do not agree to these Terms, you may not use our Services. These Terms apply to all visitors, users, job seekers, recruiters, and others who access or use the Services (“Users,” “you,” or “your”).

​1. Eligibility & Account Creation
You must be at least 16 years old and legally capable of forming a binding contract to use our Services. If you are using the Services on behalf of a company or organization, you represent and warrant that you have authority to bind that entity to these Terms.

You agree to provide accurate and complete information when creating an account and to keep this information updated. You are solely responsible for the activity on your account and maintaining its confidentiality.
​2. Use of the Services
WorkSwipe provides a digital platform for job seekers to create video profiles and for employers to evaluate candidates for employment opportunities.

You agree to use the Services only for lawful purposes, and in accordance with these Terms and all applicable local, provincial, and federal laws in Canada and abroad.
3. User Content & Media Submissions
You may submit content including video resumes, profile information, text, audio, or images (“User Content”) solely for recruitment purposes.

By submitting User Content, you grant WorkSwipe a limited, non-exclusive, royalty-free, worldwide license to host, use, reproduce, and display your content solely for the purposes of providing and promoting the Services.

You retain ownership of your User Content. You are responsible for ensuring that any submitted content:

Does not infringe the intellectual property or privacy rights of others;

Does not contain misleading, discriminatory, or unlawful material;

Is used only in the context of job seeking and recruitment.
4. Employer Use & Recruitment Responsibilities
Employers are responsible for ensuring their use of the platform and their recruitment practices comply with applicable employment, privacy, and human rights laws.

WorkSwipe does not vet or guarantee candidate qualifications, nor do we participate in hiring decisions. Employers must perform their own due diligence before proceeding with any hiring action.
5. Fees and Payments
Some features of the platform may be offered for a fee. All prices are in Canadian Dollars (CAD) unless otherwise stated. Fees are non-refundable unless otherwise required by law or explicitly stated.
We may use third-party payment processors; you agree to their terms when submitting payments.
6. Privacy & Data Use
Your privacy is important to us. Our [Privacy Policy] explains how we collect, use, and protect your personal data. By using the Services, you consent to our use of your data in accordance with the Privacy Policy.

All media content (e.g., videos, images) is used solely for recruitment-related purposes. We do not sell, license, or distribute user media or data to third parties for advertising or commercial use beyond the Services.
7. Intellectual property rights
All content, trademarks, logos, and technology provided by WorkSwipe (excluding User Content) is our intellectual property or licensed to us, and is protected under Canadian and international copyright and trademark laws.

You may not reproduce, distribute, modify, or create derivative works of our Services without our prior written consent.
8. Prohibited Conduct
You agree not to:

Impersonate others or provide false information;

Use bots, scrapers, or other automated systems;

Upload harmful, obscene, defamatory, or illegal content;

Interfere with the security or proper functioning of the Services;

Use the platform for anything other than job recruitment purposes.

Violation of these rules may result in suspension or termination of your account.
9. Termination
You may stop using our Services at any time. We reserve the right to suspend or terminate access if you violate these Terms or engage in activity that harms our platform or users.

Upon termination, certain sections (e.g., Intellectual Property, Disclaimers, Indemnification, Governing Law) will continue to apply.
10. Disclaimers and Limitation of Liability
No Guarantee of Employment: WorkSwipe provides a platform for connection, but does not guarantee any employment outcome.
The Services are provided “as is” and “as available” without warranties of any kind. To the maximum extent permitted by law, we disclaim all warranties, express or implied.

WorkSwipe is not liable for indirect, incidental, or consequential damages, including loss of employment opportunities, data, or reputation.
11. Indemnification
You agree to defend, indemnify, and hold harmless WorkSwipe, its directors, employees, contractors, and agents from any claims, liabilities, or expenses arising from:

12. Dispute Resolution & Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any legal action or proceeding shall be brought in the courts of Ontario.

You agree to first attempt to resolve disputes informally with us before pursuing formal legal action.
13. Modifications to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the new version with a revised effective date.
Continued use of the Services after changes are posted constitutes acceptance.
